T.R., a student at Long Island University, went on Facebook to voice his displeasure at the University’s treatment of him. He also indicated that the University may have a “suicide situation” on its hands. The University and the Kings County District Attorney’s Office contended that this post was criminal in nature. In a compelling legal argument, Ezra C. Levy, moved the Court to dismiss all charges on the grounds that T.R.’s statements of displeasure were protected speech under the First Amendment. In a thoughtful decision, Judge Claudia Daniels-DePeyster dismissed all charges, relying on the arguments and the caselaw cited in Ezra C. Levy’s motion to dismiss.
