The Law Offices of Ezra C. Levy, Esq. scored another legal victory, successfully moving the Criminal Court to dismiss charges against a client arrested and charged with Assault in the Second Degree for an over-reaction on the part of hospital staff, NYPD and the Brooklyn D.A.’s Office.
M.B., an entrepreneur with no prior arrest record, went to visit his fiancé in the emergency room. After being denied entry to see his fiancé, M.B. persisted and was arrested for supposedly assaulting an emergency room nurse. The videotape surveillance secured by the Law Offices of Ezra C. Levy, Esq. clearly demonstrated that no criminal behavior took place, just an over-reaction on the part of hospital staff. Ezra C. Levy pushed the case along, always ready to try the case if necessary.
The Brooklyn D.A.’s Office failed to get its act together in a timely fashion, and Ezra C. Levy filed a motion to dismiss on grounds that M.B.’s speedy trial rights were violated. In a thoughtful decision, Judge Rachel E. Freier dismissed all charges, relying on the arguments and the caselaw cited in Ezra C. Levy’s motion to dismiss. The Law Offices of Ezra C. Levy, Esq. thanks M.B. for entrusting the Office with his case and congratulates him on his legal victory!
